dc.description.abstract In recent years, social recognition on seriousness of environmental conflicts has grown and accordingly, resolving those conflicts are in great demand. However, practical and effective conflict resolution programs have not been introduced. These environmental conflicts and disputes result in project delay and socially-ill effects such as social costs incurred by unproductive disputes, distrust on the government, and clash among the stake-holders. The purpose of this study is to analyze the causes of environmental conflicts, to identify legislative system that needs improvement, and to set the basic direction for conflict resolution through examining environmental conflict cases selected by 'The Participatory Government'. According to causes of conflict, environmental conflicts can be classified into conflict on values, conflict on interests, conflict on facts, and conflict on structure. Value conflict reflects confrontation between development and preservation. Fact conflict is related to uncertainty of information and knowledge on environment. Conflict on facts occurs especially when dealing with a large-scale project where we are not able to accurately measure the degree and scope of conflicts. Lastly, structural conflict can be resolved to some degree by reorganizing systems and putting sensible and transparent process in place. Environmental conflict cases that 'The Participatory Government' has faced are all featured by four causes of conflict mentioned above. To take Seoul Ring Road and Gyeongbu rapid-transit railway for example, the aspect of value conflict has become an issue when the aspect of interest is insignificant. Other cases such as Gyeongin canal, Saemangeum, Bu-an, and Han-tan river reflect the aspects of both the value conflict and interest conflict together. To some degrees, fact conflict and structural conflict appear in all the cases. For most disputed environmental conflict cases, it is not easy to judge validity or discriminate between truth or error. To ease and resolve environmental conflicts, we need to set up a cooperative framework for mutual agreement on a long term basis. In order to achieve this, Strategic Environmental Assessment needs to be introduced by modifying the current Environmental Impact Assessment and Prior Environmental Review System. In addition, we need to encourage citizens to participate in planning and implementation of business projects or programs from the early stages of a development activity. Since every environmental conflict can not be prevented, ex post facto conflict managing system can be considered. When the government gets involved as one of the stake-holders in environmental conflicts such as Gyeongin Canal, Bu-an, and Han-tan river, National Environmental Dispute Resolution Commission is not able to play a role of mediator. Therefore, the establishment of the third party that can mediate conflicts when the government becomes a stake-holder is necessary. It is desirable to consider establishing a third party mediator in the context of alternative means of dispute resolution. Enactment of the 'Conflict Management Fundamental Law'(a provisional name) and the Establishment of 'Conflict Management Support Center'(a provisional name), that are presently driven by the Presidential Commission on Sustainable Development, will be the first step in institutionalization of Alternative Dispute Resolution. -

dc.description.bibliographicalintroduction 최근 들어 환경갈등의 심각성에 대한 사회적 인식이 확산되면서 갈등해결에 대한 요구 또한 높아지고 있지만 구체적이고 효과적인 갈등해결방안은 쉽게 마련되지 않고 있다. 이러한 환경갈등과 분쟁은 사업의 지연 및 비생산적인 갈등의 지속으로 인한 사회적 비용, 정부에 대한 불신, 이익집단간의 충돌 등 사회적 부작용을 초래한다. 본 연구는 참여정부가 선정한 주요 환경갈등 사례(경인운하, 새만금, 서울외곽순환도로 사패산터널, 경부고속철도 금정산?천성산 구간, 방사성폐기물저장시설(부안), 한탄강 댐)를 대상으로, 환경갈등의 원인을 분석하고 갈등의 해소 또는 완화를 위해 필요한 제도개선 사항 및 기본방향을 도출하는 것을 목적으로 한다. 환경갈등은 갈등의 원인에 따라 가치관 갈등, 이해관계 갈등, 사실관계 갈등, 구조적 갈등으로 구분할 수 있다. 가치관 갈등은 개발과 보전의 대립이 투영된 것으로 쉽게 해소되기 어려운 갈등이다. 사실관계 갈등 역시 환경문제가 갖는 지식과 정보의 불확실성과 관련된 것으로, 이 역시 쉽게 해소되기 어렵다. 이해관계 갈등의 경우에도 대규모 사업의 경우에는 피해의 정도나 범위를 정확하게 규명하는 것이 쉽지 않은 일이다. 마지막으로 구조적 갈등 문제는 제도를 재정비하고 합리적이고 투명한 절차를 통해 일정 정도 해소될 수 있다. 실제로 주요 환경갈등 사례를 보면, 가치관 갈등, 이해관계 갈등, 사실관계 갈등, 구조적 갈등이 혼재되어 있다. 서울외곽순환도로 사패산 터널이나 경부고속철도 금정산?천성산 구간의 경우 이해관계 갈등이 미약한 상태에서 가치관 갈등이 핵심 쟁점으로 부각되었다. 경인운하, 새만금, 부안 방사성폐기물처분장, 한탄강 댐의 경우 가치관 갈등과 이해관계 갈등이 중첩되어 복잡한 갈등구조를 보였다. 그리고 정도의 차이는 있지만 사실관계 갈등과 구조적 갈등은 거의 모든 사례에서 문제가 되었다. 사회적으로 논란이 되는 주요 환경갈등의 경우 명확하게 타당성을 판단하거나 진위를 판단하는 것이 어려운 경우가 대부분이다. 따라서 이러한 환경갈등의 완화 또는 해소와 관련해서는 장기적인 관점에서 협력적인 합의형성의 틀을 갖추어 나가는 것이 필요하다. 이를 위해 우선적으로 현재의 환경영향평가제도 및 사전환경성검토제도를 개선하여 전략환경평가(SEA)를 적극적으로 도입할 필요가 있으며, 이러한 전략환경평가의 도입과 병행하여 각종 계획 및 사업의 수립 단계에서부터 시민(지역주민, 학계 전문가, 환경운동단체 활동가 등)의 참여를 적극적으로 유도해야 한다. 한편 모든 환경갈등을 사전에 예방할 수는 없는 만큼, 사후적으로 갈등을 완화할 수 있는 장치를 마련하는 것도 필요하다. 경인운하, 새만금, 서울외곽순환도로 사패산터널, 경부고속철도 금정산?천성산 구간, 방사성폐기물저장시설(부안), 한탄강 댐 등의 경우처럼 정부가 추진하는 개발사업가 관련해서 심의적 의사결정기법을 통해 일반시민들을 갈등해소과정에 직접 참여시키거나 조정자 역할을 수행할 수 있는 제3의 기구를 설치하여 갈등의 조정에 나서게 하는 방안이 모색되어야 한다. 현재 지속가능발전위원회에서 추진하고 있는 가칭 ‘갈등관리기본법’의 제정과 동법에 포함된 ‘갈등관리지원센터’의 설치는 대안적 분쟁해결의 제도화를 위한 첫걸음이 될 수 있을 것이다. -
