dc.description.abstract Climate Change Negotiations for the Post-Kyoto Regime Key Issues and Implications I International efforts against global warming have been taken place since the UN Framework Convention on Climate Change (UNFCCC) was adopted at the Earth Summit in Rio de Janerio in 1992. The Kyoto Protocol, adopted in 1997, was the first international agreement to impose binding targets for industrial countries and eastern European countries to reduce greenhouse gas emissions. Since the Kyoto Protocol took effect in 2005, the international negotiations on how to implement the Convention and the Protocol have been full-fledged. The 13th session of the Conference of Parties to the UNFCCC in Bali, Indonesia, adopted Bali Action Plan and launched a new set of negotiation processes for the post-2012 climate change regime. As Bali Action Plan mandated the negotiation process to be concluded at its 15th session in Copenhagen, Denmark, in December 2009, it is imperative to study key issues and implications of climate change negotiations for the post-2012 regime. Korea's economy is particularly vulnerable to any internationally binding targets for greenhouse gas emissions, as it is heavily dependent on energy-intensive industries and import-dependent energy sources. Accordingly, scientific analysis and understanding of key issues and implications of recent developments of the UN climate change negotiations are of utmost importance to Korea's economy and policy design. This study analyzes the economic impact of various emission targets currently under discussion in the international community and provides policy advice with regard to future climate change negotiations. A series of five negotiation conferences had been held in 2009 before Copenhagen(COP15); however, the wide division between the developed and the developing countries had not been narrowed until the last day of the two-week long conference. As a result, the Copenhagen meeting failed to produce a legally binding agreement for the post-2012 climate regime and instead provided a political agreement entitled the “Copenhagen Accord” that was reached through a closed-door negotiation led by the heads of 28 nations. While the Accord received criticism due to the lack of procedural transparency, it earned credits in that it drew the consensus among the world's largest emitters, like the US and China, who had been reluctant to participate in global mitigation actions. The Copenhagen Accord includes the target of limiting global warming to 2°C above pre-industrial level and promises the delivery of short-term and mid-term financial aid to developing countries. It is however unclear how the targets will be achieved. What the accord also lacks are agreements on some of most critical issues, including the continuity of the Kyoto Protocol, the legal nature of an agreed outcome, individual mitigation targets, the comparability of efforts among developed countries, and the compliance systems. Two-track negotiations, one under the Convention and the other under the Kyoto Protocol (AWG-LCA and AWG-KP), were granted to be extended until the next Conference of Parties (COP16) scheduled in Mexico at the end of 2010. Accordingly, these remaining issues will be continued to be discussed in negotiation meetings up to COP16. As the legal standing of Copenhagen Accord remains uncertain, there are some possible scenarios on post-Copenhagen negotiations and their outcomes. The first scenario is that the Kyoto Protocol will be sustained along with the Copenhagen Accord. In this case, the Kyoto Protocol continues to bind Annex I country Parties (except the US) while the Copenhagen Accord focuses on the mitigation activities of the US and developing countries. Based on the result of the Copenhagen meeting, the probability of this scenario has decreased. The second scenario is that future negotiations will actively flesh out the Copenhagen Accord and lead to an official adoption of the accord as a legally binding instrument at COP16, replacing the Kyoto Protocol. The third scenario is that future negotiations will continue to be in a deadlock over some of critical agenda items, and not adopt the accord as a legally binding agreement at COP16. This may mean that the UN's role will be limited to containing the domestic pledges of each country while lacking any compliance mechanism to ensure if and how these pledges are being met. Multilateral meetings among major countries such as the G20 or MEF may develop into major forums for discussing climate change issues under this scenario. Based on the foregoing scenarios, the followings are some of the important implications of the Copenhagen meeting that the Korean government may consider for its future negotiations. Firstly, the Copenhagen Accord positively reflects Korea's positions throughout the negotiations over the past two years for the following reasons. First, it maintains the distinction between Annex I and non-Annex I countries for mitigation commitments, thus decreasing international pressure on Korea to join the Annex I countries. Second, it recognizes unilateral mitigation actions by developing countries without international support. Third, it provides a different measurement, reporting, and verification (MRV) system for such unilateral mitigation actions. These three features included in the accord were among the most important agenda items that the Korean negotiation delegates have put forward. Accordingly, Korea should strive to give the Copenhagen Accord full legal standing at COP16 so that it has a stable legal status for the post-2012 climate regime. Korea will need to submit its domestic target to the UNFCCC Secretariat by the end of January 2010 as stipulated in the accord and actively engage itself in the negotiation processes until COP16. For legal stability and certainty, the Copenhagen Accord is better to be adopted as a new Protocol, rather than a COP Decision. Secondly, the Copenhagen Accord uses the term of "developed and developing countries" for financial aid commitment instead of "Annex I and non-Annex I countries" as used for mitigation commitment. This difference in terminology suggests that Korea, a non-Annex I country, yet arguably a developed country, may be subject to strong pressure from the Annex I countries to contribute to financial aid for developing countries. The agreement on a fair and reasonable share among donating countries will be a major issue in the negotiation. Thirdly, the Copenhagen Accord briefly mentions the different levels of MRV among developed and developing countries without going into detail. Accordingly, future negotiations will concentrate on how to operationalize the terminological difference in actions. In particular, the term “international consultation and analysis” shall be materialized in reality to meet the fine balance between international review and national sovereignty. Furthermore, Korea's domestic mitigation target (30% emissions reductions from business as usual by 2020) is proven to be comparable with other countries, including some of most developed countries. Korea will need to actively convey to negotiating partners that Korea's voluntary target is among the highest level of comparable efforts. It should be emphasized that imposing the same level of mitigation targets based on the emission level at a certain reference year is highly unfair. The importance of the BAU reference should be reinforced as well. The difficulty regarding the BAU reference is a technicality, which can be overcome by using various authoritative research data released by international organizations such as the EIA and the IEA. This study indicates that Korea's BAU target appears higher than that of the US and EU. Given the higher mitigation costs compared to other developed countries, Korea's level of ambition should be given due credit. It is also important to clarify that historical emissions per capita (responsibility indicator) and GDP per capita (capability indicator) should be fully reflected in setting mitigation targets for countries with different circumstances. Finally, it is important to note that Korea may face various legal, economic, and diplomatic conflicts with other countries, particularly with advanced economies such as the US and EU even though its domestic emission targets may be purely voluntary with no international sanctions attached. In particular, it is worth emphasizing that Korea's economic impact will depend heavily on the level of China's mitigation efforts. Korea should therefore actively engage itself in and closely coordinate with various major multilateral meetings concerning climate change in which China's mitigation policies are being discussed and evaluated. -

dc.description.bibliographicalintroduction 1992년 브라질 리우에서 개최된 정상회의에서 기후변화협약이 채택된 이래 국제사회는 지구 온난화에 따른 기후변화 문제를 해결하고자 꾸준한 노력을 기울여 왔다. 1997년 일본에서 개최된 제3차 당사국총회에서는 선진국 및 동구권 국가의 감축의무를 명문화한 교토의정서가 채택, 2005년 발효됨으로써 기후변화에 대한 최초의 범지구적 구속력 있는 대응체제를 마련하는 쾌거를 이루었다. 이후 온실가스 배출에 따른 각국의 온실가스 감축의무 설정과 이의 이행방안과 관련하여 범지구적 협상이 가속화되어 왔다. 특히, 2007년 인도네시아 발리에서 개최된 제13차 당사국총회에서는 2012년 이후의 범지구적 기후변화체제 구축을 위한 협상 프로세스인 발리행동계획이 채택되어 포스트 교토체제에 대한 협상이 본격화되었다. 발리행동계획에 따라 포스트 교토체제에 대한 협상을 금년(2009년) 12월 덴마크 코펜하겐에서 개최되는 제15차 당사국총회까지 완료하기로 결정됨에 따라 이에 대한 대응전략 연구가 시급한 실정이다. 특히, 에너지 다소비형, 대외 의존적 경제구조를 갖고 있는 우리나라는 국제 온실가스 규제에 취약한 입장이어서 국제 온실가스 감축의무 협상의 파급효과에 대한 과학적 분석 및 체계적 대응전략 개발이 매우 중요하다고 할 수 있다. 따라서 본 연구에서는 국제 온실가스 감축의무에 대한 최신 협상동향 및 감축의무 설정에 따른 영향 분석을 통해 국가 온실가스 감축 관련 협상 대응방향을 제시하고자 한다. 12월 협상타결을 위해 금년에는 제15차 당사국총회에 앞서 5차례의 회의가 개최되었으나, 감축 및 재원 등 핵심의제에 대한 선진국과 개도국의 첨예한 의견대립으로 협상의 교착상태가 지속되었다. 그 결과, 코펜하겐 회의는 결국 포스트 교토체제에 대한 구속력 있는 합의 도출에는 실패하고, 주요 28개국의 비공식 회담을 통해 코펜하겐 합의문(Copenhagen Accord)이라는 정치적 결의안만을 도출한 채 막을 내렸다. 본 합의문은 일부 주요국 위주의 일방적 회의 운영하에 도출된 투명성이 결여된 문서라는 비판이 제기되어 총회 결정문으로는 채택되지 못하고 향후 이를 유의하기(take note)로 한다는 정도로만 결론지어졌다. 그러나 본 합의문은 미국 및 중국 등 주요 개도국이 참여하였을 뿐만 아니라 주요국 정상들이 참여하여 도출된 문서라는 점에서 의미가 있는 것으로 평가된다. 본 합의문은 2℃ 이하의 기온상승 억제라는 장기목표 제시와 함께 선진국의 개도국 지원금 확대 등의 내용을 포함하고 있지만 발리회의 이후 주요 협상쟁점이었던 교토체제의 존속, 새로운 합의의 법적 형태, 범지구적 감축 수준, 미국의 참여와 그로 인한 선진국 간 상응성, MRV 설계 및 의무준수체제 개선 등의 내용은 담고 있지 않다. 두 개의 협상트랙인 AWG-LCA와 AWG-KP가 내년 12월 멕시코에서 개최되는 제16차 당사국총회까지 존속하기로 결정됨에 따라 이러한 협상쟁점들은 앞으로 계속 논의될 것으로 예상된다. 코펜하겐 합의문이 추후 협상에 미치는 영향이 불확실한 가운데 예상할 수 있는 향후 협상 시나리오는 다음과 같다. 첫 번째 시나리오는 코펜하겐 합의문과는 별개로 교토의정서가 존속되는 체제다. 본 시나리오가 실현되기 위해서는 교토의정서를 유지하려는 개도국의 협상력, 미국의 여타 선진국과 상응한 수준의 감축목표 제시와 더불어 개도국에 대한 높은 수준의 재정 및 기술적 지원 약속 등이 보장되어야 할 것이다. 그러나 이러한 시나리오는 코펜하겐 협상결과를 볼 때 다소 가능성이 떨어지는 것으로 판단된다. 두 번째 시나리오는 향후 협상이 코펜하겐 합의문을 중심으로 충실하게 발전되어 새로운 국제적 합의가 채택되고 교토의정서 중심의 체제가 사실상 막을 내리는 상황이다. 이 시나리오가 가능하기 위해서는 새로운 국제적 합의가 지금까지 발전되어 온 교토체제의 핵심내용을 상당부분 포함하여 개도국의 반발을 최소화할 수 있어야 할 것이다. 새로운 국제적 합의가 서명과 비준절차 등을 통해 안정적인 법적 지위를 얻기 위해서는 최대한 많은 당사국의 적극적인 지지가 필요하기 때문이다. 이를 위해 무엇보다 선진국과 개도국 간의 감축행동 이행현황을 측정(Measure), 보고(Report), 검증(Verify)하는 시스템이 분명하게 차별화되고, 개도국의 감축목표 미달성 시 국제적 제재가 없도록 명시적인 합의가 전제되어야 할 것이다. 세 번째 시나리오는 내년(2010년) 당사국총회까지도 협상에 있어서의 특별한 진전이 없고 코펜하겐 합의문도 큰 지지를 얻지 못하여 결국 총회에서 정식 법적 문서가 채택되지 않는 상황이다. 이는 기후변화체제를 이끌고 나갈 UN의 역할과 기능이 크게 축소되어 모든 국가의 감축의무는 국내적 의무로 국한되고 기존의 UNFCCC는 단지 국가별 감축의무를 기록, 검토하는 역할만을 담당하게 되는 가능성을 의미한다. 이 경우 G20, MEF와 같은 주요국의 다자회담이 기후변화 아젠더를 적극적으로 논의하는 새로운 장으로 부각될 가능성이 높다. 상기와 같은 협상 전망을 바탕으로 향후 협상에서 우리나라가 고려해야 할 사항들을 정리하면 다음과 같다. 첫째, 코펜하겐 합의문은 협상 최대 쟁점이었던 감축부문에 있어서 (1) 부속서 I/비부속서 I 국가 표현을 유지하고 있음에 따라 우리나라의 향후 의무감축국으로의 편입 압박을 감소시키고, (2) 지원받지 않는 개도국의 자발적 감축행동을 인정하며, (3) 자발적 감축행동의 국내 검증과 국제 자문 및 분석을 통한 국제적 인정을 받을 수 있는 수단을 마련하였다는 점에서 우리나라의 입장이 잘 반영된 합의문인 것으로 판단된다. 따라서 우리나라는 코펜하겐 합의문에 따라 국가 감축행동을 (2010년 1월까지) 등록하고, 코펜하겐 합의문이 내년 당사국총회까지 확실한 법적 지위를 얻고 향후 기후체제를 설계할 기본 문서로 발전될 수 있도록 협상에 적극적으로 대처해야 할 것이다. 코펜하겐 협상문의 법적 형태에 있어서는 구속력을 지닌 새로운 의정서로 채택되는 것이 향후 기후변화체제에서의 안정성 확보를 위해 바람직할 수 있다. 그리고 우리나라의 감축행동이 기재되는 부록(Appendix II) 또한 새로운 의정서의 일부로 포함되어 법적 구속력을 지니게 된다면, 의정서의 본문에는 반드시 부속서 I 국가와 비부속서 I 국가 간의 감축행동의 강제성, 불이행 시 법적 결과 및 MRV 수준과 강도가 차별되어야 한다는 내용이 포함되어야 할 것이다. 둘째, 코펜하겐 합의문에서 재정부담과 관련된 국가구분이 선진국/개도국으로 표현된 점은 앞으로 우리나라에게 개도국 지원을 위한 재원조성 기여 압력이 높아질 수 있음을 내포한다. 따라서 이러한 재원조성 기여 압력에 대비하기 위해서는 공평하고 합리적인 국가 간 재정분담비율에 관한 합의도출 도모가 무엇보다 중요할 것이다. 셋째, 코펜하겐 합의문은 선진국과 개도국의 보고?측정?검증(MRV)의 차별화를 간단히 기술하고 있으나, 향후 협상에서는 이를 구체화(operationalize)하기 위한 논의가 계속 될 것으로 예상된다. 특히, 코펜하겐 합의문에서 제시하고 있는 개도국 감축행동에 대한 ‘국제적인 자문과 분석(international consultation and analysis)’이라는 표현은 처음으로 쓰인 새로운 용어다. 추후 협상에서 이와 같은 표현이 구체적으로 어떤 식으로 정의되어 국제적 인정과 주권불침해라는 상반된 논리의 균형을 맞추며 구현될 수 있을지 협상 추이를 면밀히 주시할 필요가 있는 것으로 판단된다. 더불어, 우리나라의 중기 감축목표(2020년까지 BAU 대비 30% 감축) 제안은 선진국과 비교할 때도 충분한 수준의 상응성이 있는 것으로 분석되었다. 따라서 향후 협상에서 이러한 점이 국제적으로 충분히 인식되고 합리적으로 평가될 수 있도록 많은 노력을 기울여야 할 것이다. 이를 위해서 감축목표를 과거 기준년도 배출수준에 대비하여 해석하는 시각의 불합리성과 BAU 대비 평가의 중요성이 강조되어야 한다. BAU의 객관적인 전망이 어렵다는 점은 기술적인 문제이며 EIA, IEA 등 다양한 공신력 있는 기관의 전망을 적극 활용함으로써 극복될 수 있다. 우리나라의 감축목표는 BAU 대비 감축비율에 있어서 미국, EU 등의 제안보다 높은 수준으로 평가되며 감축비용에 있어서 경제규모를 고려할 때 훨씬 더 강력한 수준으로 평가되어야 한다. 또한 국가 간 상응성을 평가함에 있어서 일인당 누적배출량과 같은 책임 지표와 일인당 GDP와 같은 능력 지표가 반영되어야 한다는 점도 충분히 인식되어야 한다. 마지막으로, 우리나라의 자발적 감축목표가 국제법상의 구속력을 갖지 않는 경우에도 감축목표의 이행과정에서는 다른 국가와 다양한 법적 및 경제적 갈등, 특히 미국, EU, 일본 등 강대국과의 갈등이 예상되므로 신중한 대응이 필요할 것이다. 특히, 우리나라의 경우 온실가스 규제에 따른 부담은 중국의 감축 참여에 따라 많은 영향을 받을 것으로 판단되므로 중국이 참여하는 폭넓은 감축정책 이행체계를 주제로 하는 다자간 협의구조를 최대한 활용할 필요가 있을 것으로 사료된다. -
