나고야의정서 하에서의 주인-대리인 이론을 통한 유전자원 이용계약 활성화 방안

Abstract

2014년 나고야의정서가 발효되었지만, 유전자원에 대한 접근과 이용으로부터 나오는 이익의 공평하고 공정한 공유(ABS)를 따르는 유전자원 이용계약은 여전히 활성화되지 않은 채 생물해적행위가 계속되고 있다. 이는 체약당사자 사이의 정보 비대칭으로 인한 유전자원 이용자의 대리인 문제가 발생하고 있기 때문이다. 유전자원 이용계약의 대리인 문제를 일정 부분 해소하고 성실한 ABS 이행이 이루어지는 유전자원 이용계약의 활성화를 위해 유전자원 이용자에게 적절한 수준의 정보지대가 지급되어야 한다. 본 연구는 유전자원 이용계약의 적절한 정보지대를 도출하기 위해 주인-대리인 이론을 적용하였다. 또한, 주인-대리인 이론을 통해 도출된 정보지대를 실질적으로 이용할 수 있도록 계약 메커니즘 및 정보지대 관리제도의 설계 방안을 제안하였다. The Nagoya Protocol on ‘Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization’(ABS) to the Convention on Biological Diversity entered into force in 2014; however, in practice, benefit-sharing contracts based on the protocol have rarely been fulfilled and are remain unsatisfactory, unable to prevent ongoing bio-piracy. Such international discontent is caused by problems of agency rooted in information asymmetry between the contracting parties-host government and resource exploiter. One solution to this problem would be to provide the resource exploiter with the appropriate level of information rent. This paper introduces a principal-agent model to calculate the level of information rent which enables such contracts to be implemented successfully. Furthermore, detailed suggestions for contract mechanisms and workable management systems for information rent are provided based on the figures derived by the principal-agent model.
