Abstract
1. 연구의 배경 ? 관계부처 간 공동주택 도로교통소음 적용 기준이 상이하여 관련 민원 발생 시 책임주체가 불분명한 점 등 이해관계자 간 수많은 사회적 갈등 우려 ㅇ 공동주택 공급단계: 환경영향평가 대상 사업 여부에 따라 적용 목적 및 기준이 상이함 - 환경영향평가 대상: ?환경정책기본법? 제12조에 따른 (소음)환경기준 적용 ? 목적: 인간의 건강에 미치는 영향 등을 고려하여 환경보전목표 설정 ? 도로변 지역의 경우, 실외 소음도 적용(주간 65dB/야간 55dB) - 30만m2 미만의 소규모 대상: ?주택법? 제42조 제1항에 따른 주택건설기준 적용 ? 목적: 주택의 건설에 따른 소음의 피해를 방지하고 주택건설 지역 주민의 평온한 생활을 유지하기 위한 소음방지대책 수립 목표 설정 ? 주·야간 구분 없이, 5층 이하 실외소음도(65dB) 및 6층 이상 실내소음도(45dB) ㅇ 교통소음 관리단계 - ?소음·진동관리법? 제26조에 따른 (도로)교통소음 관리기준 적용 ? 목적: 도로 운영 시 자동차에서 발생하는 소음을 관리하기 위한 기준 규정 ? 도로의 경우, 실외 소음도 적용(주간 68dB/야간 58dB) ? 창문을 열고 정온한 생활환경을 영위할 수 있는 환경권을 보전하기 위한 제도적 개선 ㅇ 주택 건설 시 소규모 공동주택은 소음 환경기준보다 완화된 기준을 적용하고 있음 - 야간에는 주간에 비해 상대적으로 소음 피해가 큰 시간대임에도 불구하고, 소음방지대책 수립 시 야간시간대 소음영향에 대해서는 고려치 않고 있음 - 준공 이후 도로 운영 시 야간시간대 소음 기준을 초과할 가능성이 높으며, 이로 인한 소음 민원도 적극적으로 대응하기 어려움 - 6층 이상 실내소음도 기준을 적용함에 따라, 고층부에서는 창문을 열고 정온한 생활환경을 영위할 수 있는 환경권을 국가가 제도적으로 보장하기 어려움 ㅇ 도로교통소음기준 일원화 관련 관계부처 간 공동 연구용역이나 공식적인 협의 절차가 추진되지 않는 등 관련 소음기준 개선에 관한 국가 차원의 세부 추진방안 부재 ㅇ 도심지 인구 밀집화에 따라 교통소음을 포함한 소음진동 피해가 환경 분쟁의 80% 이상을 차지하는 등 교통소음 관리의 선제적 대응이 필요한 실정임 2. 연구 목적 및 세부 목표 ? 연구 목적 ㅇ 관계부처 간 상이한 도로교통소음 관련 제도를 합리적으로 개선할 수 있는 방안을 마련하여, 공동주택 주변 교통소음 완화 정책에 기여하고자 함 ? 세부 목표 ㅇ 도로교통소음 관리 현황 분석을 통한 시사점 도출 ㅇ 공동주택 주변 도로교통소음 관리기준의 합리화방안 마련


1. Background ? Since the standards of road traffic noise for multi-unit houses differ at related government departments, there is much concern about many possible social conflicts between stakeholders, such as unclear assignment of responsibilities when related complaints occur. ㅇ Stage [1], constructing multi-unit houses: Application purposes and standards differ depending on whether the project is subject to Environmental Impact Assessment. - Projects subject to Environmental Impact Assessment: ‘Environmental quality standards for noise’ are applied (under the Article 12 of the “Framework Act on Environmental Policy”). ? Purpose: Set environmental conservation goals in consideration of human health impacts ? For roadside areas, outdoor noise standards are applied (65dB during the day / 55dB at night). - Small-scale projects (smaller than 300,000 square meters): ‘Housing Construction Standards’ are applied (under the Article 42 (1) of the “Housing Act”). ? Purpose: Set noise prevention measures ① to prevent noise damage caused by the construction of houses and ② to preserve a peaceful living environment for residents nearby a housing construction site. ? No distinction between day and nighttime, ① below 5th floor: outdoor noise standard 65dB and ② above 6th floor: indoor noise standard 45dB ㅇ Stage [2], managing traffic noise - (Road) traffic noise management standards are applied (under the Article 26 of the “Noise and Vibration Control Act”). ? Purpose: Establish standards for the management of road traffic noise generated by cars during road operations ? For roads, outdoor noise standards are applied (68dB during the day / 58dB at night) ? System Improvements to preserve the environmental right to open a window and enjoy a peaceful living environment ㅇ In the construction of housing, Housing Construction Standards are applied to small-sized houses rather than Environmental quality standards for noise. - When establishing the noise prevention measures, night-time noise is not considered even though noise damage at nighttime is greater than during the day. - After construction, noise from the roads is likely to exceed night-time noise standards and it is also difficult to actively respond to subsequent noise complaints. - Since the indoor noise standards for the 6th floor and above is applied, it is difficult for the government to systematically guarantee the environmental right to open windows and enjoy a peaceful living environment for residents living in the upper stories of buildings. ㅇ There is a lack of detailed national measures to improve the relevant noise standards, including a lack of any joint research program or formal consultation procedures among related ministries related to the unification of road traffic noise standards. ㅇ Proactive response to (road) traffic noise management is needed to deal with the noise and vibration damage including traffic noise which accounts for more than 80% of environmental disputes due to high concentration of urban population.
