Ⅰ. 서론: 연구의 필요성 및 내용 ? 코로나19의 장단기 충격에 효과적으로 대응하기 위한 환경규제 개편 필요 ㅇ 코로나19의 단기 충격에 대응하는 환경규제의 조정 및 중장기 충격에 대응하는 규제개편 방향에 대한 모색이 필요 - 단기 충격은 코로나19의 유행 이후에 종료되는 충격: 방역과 관련된 활동을 제외한 인간 활동이 위축되면서 환경오염물질 배출량 및 구성이 급격히 변화 - 중장기 충격은 코로나19의 유행 이후에도 영향이 지속되는 충격: 충격의 크기 및 지속기간에 따라 비가역적으로 규제환경이 변화 ㅇ 단기적으로는 방역 관련 환경오염물질 배출량이 증가하고 대면접촉 규제집행 및 준수 부담이 증가하며 규제완화 압력이 증가 - 규제완화 압력: 환경오염은 자연적으로 개선되는데 경기는 침체되어 환경규제 완화 압력이 강화되는 환경이 조성 ㅇ 중장기적으로 코로나19의 유행은 디지털화를 강화시켜 소규모 배출원의 배출량 비중을 증가시킬 전망 - 코로나19의 영향으로 데이터 응용기술을 사용하여 대면접촉의 필요를 제거한 생산-유통-고용-소비 행위가 선택 가능한 대안에 편입 ㅇ 단기적인 의료폐기물 급증 및 대면접촉 위험 증가, 중장기적인 소규모 배출원 배출 비중 증대에 효과적으로 대응하기 위해서는 환경규제 개편 필요 - 단기: 통상적 폐기물 배출량 규모 소화 및 대면접촉을 통한 규제 준수를 전제로 설계되어 의료폐기물의 급증 및 대면접촉 위험 증대 대응에 한계 - 중장기: 대규모 사업장 관리 위주의 직접규제 중심이어서 소규모 사업장 배출량 비중 증대 대응에 한계 ? 단기적인 영향은 코로나19의 의료적 대응책 개발 이후 소멸되는 영향, 중장기적인 영향은 코로나19의 의료적 대응책 개발 이후에도 지속되는 영향을 의미 ㅇ 중장기적 영향은 코로나19가 기존에 진행되는 추세를 가속화시키는 경우에 발생 ? 단기적으로 코로나19는 대기오염도 개선 및 의료폐기물-플라스틱폐기물 배출량 증대를 야기하였으나 2020년 9월 이후 대기오염물질 배출행위는 회복 중 ㅇ 2020년 2분기 수출의 위축에 따라 제조업 생산이 위축되면서 대기오염물질 배출량 비중이 높은 산업의 생산이 위축되어 대기오염도 개선 - 수질오염 개선 효과는 산단하천의 경우에만 개선 징후가 있으며, 하천, 호소, 도시관류의 경우에는 명확한 개선 징후가 보이지 않음 - 온실가스 배출량의 원인인 화석연료 수입량 및 유류제품 소비량은 2020년 8월까지 감소하였으나 9월 이후부터는 회복 ㅇ 2020년 1~9월 감염위험이 높은 격리의료폐기물 배출량은 전년 동기 대비 1.6배 증가하였고 플라스틱폐기물 배출량은 재활용폐기물 배출량보다 빠르게 증가 - 1회용 기저귀 의료폐기물 지정 제외 및 코로나19로 인한 여타 질환 진료 지연으로 인해서 의료폐기물 배출량은 오히려 17.0% 감소 · 2020년 2분기 전년 동기 대비 의료서비스산업 실질 GDP 증가는 0.38%에 그침 - 배달 소비 증가에 따른 포장재폐기물 배출량이 증가: 2020년 상반기 플라스틱폐기물 배출량 증가율은 15.6%로 재활용폐기물 증가율 11.2%를 상회 ㅇ 2020년 9월 이후 제조업 수출 물량, 화석연료 수입량, 유류제품 소비량, 중소형차량 고속도로교통량이 회복세를 보여서 코로나19의 충격에 적응하는 양상 ? 단기적으로 코로나19는 대면접촉 수반 규제 준수 부담 증대를 야기하였고, 기업의 규제 준수 비용 지원 요구를 강화 ㅇ 현재 환경규제의 집행에는 오염원의 환경기준 준수 및 환경오염 방지기술 적용 여부를 확인하기 위한 현장실사가 필요하여 코로나19로 인한 대면접촉 위험 증대에 취약 ㅇ 코로나19로 인한 경기침체와 규제 준수 부담의 증가 때문에 기업은 환경규제 준수의 부담을 체감하고 있으며, 규제 대응 투자비용 지원에 대한 요구가 증가 - 2020년 9월 이후 경제활동이 회복되고 있어서 규제완화 논거는 약화 ? 중장기적으로 코로나19는 디지털화(Digitization) 경향을 가속화시켜서 소규모 사업체 및 가정 등 소규모 배출원의 오염물질 배출 비중을 증대시킬 가능성 존재 ㅇ 코로나19의 영향으로 대면접촉 빈도를 낮추는 IT기술의 장점이 부각되면서 21세기 이후 지속된 디지털화를 가속화 - (예) 생산공정의 자동화, 원격근무 확산, 다품종 소량 배송방식 확대, 자율주행 자동차 수요 증대, 온라인 소비 및 배달 소비 증가, 온라인 콘텐츠 소비 확대 ㅇ 과거 ‘필수적’이었던 대면접촉을 ‘선택’의 대상으로 전환하여 기업 및 가계의 비용절감 가능성을 확대: 코로나19 이후에도 선택 가능성을 유지할 유인을 부여 ㅇ 디지털화는 소규모 생산자의 생산량 및 가정 내 소비량의 비중을 증대시켜서 소규모 배출원의 배출 비중을 증대 - 생산: 소규모 생산자가 경쟁력이 있는 실시간 소비자 선호 반영시장을 창출하고 시장의 진입장벽을 낮추어 소규모 생산자 시장 참여 촉진 - 소비: 원격근무의 확대 등으로 가정 내 소비활동이 증가 ㅇ 소규모 배출원 비중이 증대하면 직접규제가 중심인 기존의 환경규제는 감시비용 부담이 증가하여 실효성이 약화될 우려 Ⅲ. 환경규제 개편 필요성 및 추진방안 1. 규제 개편 필요성 진단 ? 코로나19 단기 영향 대응: 폐기물 규제 소폭 개편 및 규제 시행 설비 증설 필요 ㅇ 코로나19로 인한 의료폐기물 및 포장재폐기물의 증가에 대응하기 위해서는 폐기물 규제의 소폭 개편 및 폐기물 처리 설비 증설이 필요 - 의료폐기물: 현재 전량 소각하는 처리방식을 멸균분쇄, 화학적 처리 등으로 다변화 - 포장재폐기물: 발생량을 억제하는 포장재 규제 도입 - 의료폐기물 소각시설 및 플라스틱폐기물 재활용 시설 점진적 증설 ㅇ 코로나19로 인한 대면접촉 규제 준수 부담 완화를 위해서는 비대면 감시, 검사, 교육 설비 도입 및 청정 검사시설 도입이 필요 - 오염도 규제 준수 감시: IT기술을 활용한 무인감시 시스템 확대 - 기술 규제 준수 검사: 검사장비 원격 가동, 검사 과정 무인화, 청정 검사시설 도입 - 각종 교육 의무: 온라인 교육 활성화 ㅇ 규제완화 압력: 의료적 해결책이 도출되지 않더라도 환경오염 배출행위 위축은 완화되는 경향이 있으므로 한시적 유예 및 소요기간 단축 등 임시적인 조치를 활용 - 대면접촉 위험 증가에 대응하는 방식이 시간이 지나면서 ‘전면적 활동 위축’에서 ‘대안적 활동으로 대체’로 전환되는 경향 존재 ? 코로나19 중장기 영향 대응: 잠재적 중장기 영향 파악 및 유인기반 환경규제 확대 ㅇ 잠재적 중장기 영향에 대한 ‘가능성 높은 작업가설’을 도출하기 위해서는 환경 관련 정보 파악 인프라 개선 및 정보 공유 범위 확대가 필요 - 코로나19는 현재 진행 중이므로 ‘가능성이 높은 작업가설’ 수준에서만 중장기 영향 파악 가능 - ‘가능성이 높은 작업가설’에 도달하기 위해서는 정보 수집 → 다양한 정보 해석 → 교차검증 → 광범위한 동의(consensus) 도출 과정의 소화 필요 · 정보 해석의 시행착오를 교차 검증을 통해서 해소하는 과정이 필수적으로 요구 - 정보 수집을 위해서는 시공간 해상도가 높은 오염물질 배출행위, 오염물질 배출량, 오염도를 상호 연계하고 실시간으로 갱신하는 환경정보 수집 인프라 필요 · 배출행위-배출량-오염도 정보의 시공간 해상도 및 갱신주기가 상이한 약점 해소 · 센서, 무인이동체 기술을 활용하여 정보 수집 대상을 확대하고 갱신주기를 단축 - 광범위한 동의 도출을 위해서는 교차검증이 가능한 집단을 대상으로 정보 공유의 범위를 전면 확대할 필요 ㅇ 디지털화 촉진에 따른 소규모 배출원 비중 증대에 대응하기 위해서는 유인기반 환경규제 도입이 필요 - 현재 환경규제는 직접규제가 중심이어서 소규모 배출원에 적용하기에는 감시비용 부담이 커서 실효성이 약화됨 - 환경세 혹은 환경보조금을 활용하여 배출원 스스로의 환경오염물질 배출량 저감 유인을 강화하는 유인기반 환경규제의 확산이 요구 - 유인기반 규제 설계, 성과 평가, 환류를 위해서 가격에 따른 배출원 행위변화-배출량 변화-오염도 변화의 관계를 파악할 수 있는 환경정보 수집 인프라 구축 필요 2. 추진방안 ? Ⅰ. Background and Aims of Research ?To accommodate short-term and long-term shocks caused by the COVID-19 pandemic, we need to modify environmental regulations. ㅇ We need to inspect if we need to modify environmental regulation to absorb short-term shocks of the COVID-19 pandemic and to accommodate long-term shocks of the COVID 19 pandemic. - Short-term shocks will disappear after the end of the COVID-19 pandemic; the amount and composition of pollutant emission change because most of human activities reduces except for medical activities. -Long-term shocks will remain after the end of the COVID-19 pandemic; depending on the size and duration of shocks, some shocks could cause irreversible changes in the circumstances regarding environmental regulation. ㅇ In the short run, the COVID-19 pandemic increased the emission of pollutants related to preventive measures and the cost of complying with the regulations on face-to-face contacts. The increase in compliance cost might have strengthened the pressure for deregulation. - Deregulation pressure: While environmental pollution decreases naturally, the recession caused by the COVID-19 pandemic strengthens deregulation arguments. ㅇ In the long run, the COVID-19 pandemic could accelerate digitization and increase the share of small emitters in pollutant emission. - To avoid contact, digital technology is widely applied in production- transportation-working-consumption. - COVID-19 made digitized ‘untact’ behaviors a viable option. ㅇ We need to revise the current environmental regulation to deal with the short-term and long-term shocks of the COVID-19 pandemic on the environment. - Short-term: Our waste management system is constructed to deal with the normal amount of medical waste. Also, most of our regulation requires contact for enforcement. Neither of these aspects is appropriate for dealing with a pandemic like the COVID-19 pandemic. - Long-term: Our pollution regulation is taking the command-control approach to control large emitters. We are not prepared to deal with the increasing share of small emitters in emissions due to digitization. ? In this report, we aim to inspect if current environmental regulations should be modified to deal with the COVID-19 pandemic and suggest proper strategies for the modification of environmental regulations. ㅇ We studied the short-run and long-run impact of COVID-19 pandemic on environmental regulation. ㅇ We suggest short-term and long-term strategies for the modification of environmental regulation. - [Short-term approach] ‘Plan for managing environmental regulation during a pandemic’: Recommendations for the management of environmental regulation during a pandemic based on the experience of the COVID-19 pandemic - [Long-term approach] ‘Roadmap for the reform of environmental regulation to accommodate the long-term shock of the COVID-19 pandemic’: Investment plans for facilities to deal with a large-scale pandemic like COVID-19 and plans for identifying and responding to the long-term shock caused by the COVID-19 pandemic Ⅱ. Impact of the COVID-19 Pandemic on Environmental Regulation ? Short-run shocks disappear after medical solutions for COVID-19 are developed. Long-run shocks will remain after the development of medical solutions for COVID-19. ㅇ The long-run shock occurs when the COVID-19 pandemic accelerates the current trend. ? In the short run, the COVID-19 pandemic decreased air pollution and increased plastic waste discharge. However, air pollutant-emitting behaviors have been on the rise since September 2020. ㅇ Air pollution decreased in the second quarter of 2020 compared to the same quarter last year due to the production reduction of high-emission industries―mostly manufacturers. Manufacturers suffered production reduction due to decreased exports. - Water pollution decreased only in industrial complexes. We did not find any significant reduction of water pollution in rivers, ponds, and urban streams. - Fossil fuel and oil products are main emitters of greenhouse gases: Fossil fuel imports and oil product consumption decreased until August 2020. However, both of them have increased compared to the same period last year since September 2020. ㅇ From January 2020 to September 2020, discharge of “medical waste from quarantine” with high contagion risks increased by 1.6 times compared to the same period last year and the rate of increase of plastic waste discharge exceeded the rate of increase of all recyclable waste discharge. - Medical waste discharge itself was reduced by 17% because medical diapers are excluded from medical wastes from 2020 and the treatment of diseases other than COVID-19 was delayed. · Value-added of the medical service industry in the second quarter of 2020 increased by only 0.38% compared to the same quarter last year. - Increased delivery-based consumption caused discharge of plastic package waste: In the first half of 2020, plastic waste discharge increased by 15.6% compared to the same period last year, while the whole recyclable waste discharge increased by 11.2% for the same period. ㅇ Since September 2020, exports of the manufacturing sector, fossil fuel imports, oil product consumption, and density of small and medium-sized vehicles on highways have increased. This common trend suggests that pollutant emitters are becoming used to the COVID-19 pandemic. ? In the short run, COVID-19 increased the cost of complying with the regulation on face-to-face contacts and strengthened the demand of business enterprises for support for subsidization of the compliance cost. ㅇ Current environmental regulations require physical monitoring of emitters’ compliance with environmental standards and the implementation of emission reduction technology. The COVID-19 pandemic increased the risk of all the physical monitoring. ㅇ Surveys on business enterprises show that firms suffer from the recession and increased compliance cost due to the COVID-19 pandemic and want to be subsidized for the implementation of emission reduction technology. - However, the ground for deregulation is weakening because economic activity have recovered since September 2020. ? In the long run, COVID-19 could accelerate digitization and consequently increase the share of small emitters in pollutant emissions like SME or households. ㅇ By revealing that digital technology can make contact with other people optional, the COVID-19 pandemic accelerated digitization which has been already spreading since the beginning of the 21st century. - examples) Robotization of production, remote working, small-quantity/ multi-products deliveries, increased demand for self-driving cars, e-commerce and delivery services, online content consumption ㅇ By making contact with other people unnecessary, digitization provided a new opportunity to reduce cost. This opportunity is likely to be exploited after the end of the COVID-19 pandemic. ㅇ Digitization is likely to increase the share of SMEs in production and the share of household consumption. Consequently, the share of small emitters in pollutant emissions is likely to increase. - Production: Digitization would expand markets that reflect consumer preferences in real-time in which SMEs have a comparative advantage. Digitization also reduces entry barriers for SMEs. - Consumption: Remote working and delivery services would increase consumption in households. ㅇ Current environmental regulation heavily relies on the command and control approach. Because of huge monitoring cost, command and control approach is less effective in controling emissions from small emitters. Ⅲ. Modification of Environmental Regulation to Respond to the COVID-19 Pandemic 1. Do we need to modify environmental regulation? ? To absorb shot-term shocks from a pandemic like COVID-19, we need minor modifications of waste regulation and investments in facilities in regard to the implementation. ㅇ To deal with the rapid increase of medical waste and plastic waste, we need to modify waste regulations and construct new facilities to dispose of waste. - Medical waste: Currently, all medical waste is incinerated. Other methods like sterilizing and grinding or chemical treatment should be considered. - Package waste: New regulation on packaging can be considered. - Facilities: New medical waste incineration facilities and plastic waste recycling facilities are needed. ㅇ To decrease compliance cost, we need facilities for ‘contact-free’ monitoring, inspection, and education. - Environmental standard compliance monitoring: Unmanned monitoring devices using IT technology -Inspection on emission reduction technology: Remote inspection, unmanned inspection facility, safe inspection facility - Education: Online education facilities ㅇ Deregulation pressure: Conservative approaches like temporary exemption are preferred because pollutant emission behaviors can return to normal state even when the medical solutions are not developed. - As time goes on, ‘refraining from activities overall’ is replaced with ‘carrying out alternative activities’. ? To accomodate long-term shocks of the COVID-19 pandemic, we need to conduct research to identify long-term shocks of the COVID-19 pandemic and apply more incentive-based environmental regulation. ㅇ To reach a ‘probable working hypothesis’ on potential long-term shocks of COVID-19, we need to reform the structure for collecting environment-related information and expand the scope of information sharing. - A ‘probable working hypothesis’ can be reached through repetition of information gathering → diverse hypotheses → cross-checking →consensus building process. - We need infrastructure for information gathering to collect and manage the following data: data on pollutant emission behaviors, amounts of emitted pollutants, and pollution levels with high spatio-temporal resolution. These data should be easily combined and regularly updated. - To build consensus, we need to expand the scope of information sharing for all groups capable of cross-checking. ㅇ We need more incentive-based environmental regulation to deal with the increasing share of small emitters in pollutant emissions due to accelerated digitization. - Current environmental regulations depend heavily on the command and control approach. Due to huge monitoring cost, the command and control approach is ineffective in controling emissions from small emitters. - To control emissions from small emitters, tax or subsidies that provide incentive to reduce emission is required. -To design, evaluate, and provide feedback on incentive-based environmental regulation, we need information collecting facilities to analyze the relation among changes in emitter behavior according to ‘price’-‘changes in emission amounts’-‘changes in pollution level’. 2. Strategies for modifying environmental regulation ? [Short-run strategy] ‘Plan for managing environmental regulation during a pandemic’: Environmental regulation management plan during a pandemic when time-consuming methods are not available ㅇ Resolve bottleneck problems of medical waste treatment: Organize and manage medical waste treatment networks, including incineration facilities not specialized for medical waste ㅇ Safe environmental regulation compliance: Adopt contact-free monitoring, inspection, education facilities, carry out disinfection at inspection facilities, and organize local networks of safe inspection facilities ㅇ Facing deregulation pressure (bylaw of the Ministry of Environment): A careful approach is needed because alternative pollutant emission activities gradually replace current pollutant emission activities. ㅇ When and how far this plan should be activated: Clarify conditions and scopes to apply this plan ? [Long-term strategy] ‘Roadmap for the reform environmental regulation to accommodate the long-term shock of the COVID-19 pandemic’: Time-consuming approaches to accommodate shocks of the COVID-19 pandemic ㅇ Identify the potential long-term shock of the COVID-19 pandemic: Improve facilities collecting data on the environment and organize and operate the ‘Research Task force for Long-term COVID-19 Shocks’ - Infrastructure for collecting environment-related information: Improve spatial-temporal resolution of environment-related information, link information on pollutant emitting behavior-pollutant emission- pollution level, and shorten the update cycle -‘Research Task force for Long-term COVID-19 Shocks’: Member selection, identification of research goals, and determination of the research period ㅇ Provide an investment plan for new facilities: Medical waste incineration facilities, plastic waste recycling facilities, contact-free monitoring- inspection-education facilities, environment-related data collecting facilities - Provide a detailed investment plan that includes facility information, an implementation plan, and a financing plan ㅇ Provide a plan for revising the law and regulation: Diversification of medical waste treatment methods, introduction of new package regulation, and application of incentive-based regulations
