환경교육 활성화를 위한 법제도 개선방안

Abstract

우리나라는 1980년대 학교 교육과정에 환경관련 내용을 포함하고, 1992년 제6차 교육과정에 환경 교과목을 선택과목으로 개설하는 등 환경교육을 위해 꾸준히 노력해왔다. 특히 2008년 환경교육 활성화와 지속가능 발전에의 기여를 목적으로 하는 환경교육진흥법이 제정되면서 환경교육의 진흥 및 지원을 위한 법적·제도적 토대가 마련되었다. 하지만 이후 다양한 사회적 변화를 반영하고 환경교육의 시행을 구체화하기 위해서 환경교육진흥법의 개정에 대한 요구가 높아지고 있다. 이에 본 연구에서는 우리나라의 환경교육 현황을 파악하고 해외 주요국의 환경교육법을 검토하여, 환경교육의 활성화를 위한 법적·제도적 개선방안을 도출하고자 하였다. 연구 결과에 따르면, 환경교육종합계획, 학교환경교육, 사회환경교육, 사회환경교육지도사, 환경교육프로그램, 환경교육센터 등 환경교육진흥법의 주요 이슈에 대해 모두 개정의 필요성이 존재하는 것으로 나타났다. 현재 환경교육진흥법상에서 의미가 모호하거나 누락되어 있는 기본 항목들을 수정·보완할 필요가 있으며, 법적 근거에도 불구하고 시행되지 못하는 부분은 추가적인 고민이 필요하다. 특히 후자의 경우에는 일부 법 조항의 강화나 다양한 의무화 방안의 필요성이 함께 제기되었다. 미국, 브라질, 일본, 필리핀, 대만, 콜롬비아의 환경교육법은 세부 항목별 개선방안 도출을 위해 참고할 수 있는 유용한 정보를 제공한다. 이러한 논의를 바탕으로 향후 연구에서는 유관 분야의 다양한 전문가 논의와 사회적 합의를 거쳐, 우리나라 환경교육의 활성화에 이바지할 수 있는 환경교육진흥법의 개정이 추진되기를 기대해본다.

Several efforts have been made to promote environmental education in Korea. In particular, the Environmental Education Promotion Act 2008, provided a legal and institutional foundation to encourage and support environmental education for the purpose of promoting environmental education and ultimately contributing to sustainable development. However, with changes in social demands, the need for amendments to the Act has been suggested continuously. In this context, this study focuses on searching for measures to improve the legal and institutional framework of environmental education by identifying the current status of domestic environmental education and further reviewing overseas environmental education laws. The study has found that all major issues related to the Act reveal demands for a certain level of revision. Ambiguous or undescribed clauses are required to be revised, and additional discussion should be conducted for ineffective articles. Moreover, the need to tighten or enforce some of the existing provisions has been presented with regard to the latter. Finally, this study is expected to provide valuable data and information for amendments to the Environmental Education Promotion Act in the near future and ultimately revitalize environmental education in Korea.
