효율적 환경자원 관리를 위한 환경행정체계의 발전방안 : 중앙정부와 지자체의 역할을 중심으로

Abstract

Efficient management of environmental resources requires harmonizing the roles of various policy actors, and properly establishing the relationships among related governmental entities. Since the local autonomy in Korea was reactivated in 1990s, a significant amount of environmental tasks have continually been devolved or delegated to local governments - which calls for proper allocation of authorities, policy coordination, and cooperation between central and local governments, and also enhancing the capacities of local governments. Focusing on the environmental decentralization (devolution and delegation), this study conducted institutional analyses of decentralization and central-local role allocation, empirical analyses of impact of decentralization, survey of stakeholders, analyses of administrative capacities and cooperative systems of local governments, in pursuit of the advancement of environmental administration system. The Chapter 2 provides literature review of intergovernmental relations of environmental administration, review of current institutions and policies, and case studies on transfer of authorities between central and local governments, to draw policy implications. As the environmental area shows higher portion of locally conducted tasks compared to other areas, it is even more imperative to strengthen the administrative capacities and cooperation systems of local governments. Also, with the ongoing abolishment of delegated tasks, more environmental tasks are being devolved to local level, and the ensuing institutional gaps should be reviewed and filled. The Chapter 3 provides empirical analyses of impacts of environmental decentralization as an extension from our previous study, and also a survey of the stakeholders (the industry sector). The panel data analyses as well as the survey results largely indicated that after the delegation or devolution the enforcement activities have either sustained or weakened, although the dataset was somewhat insufficient to confirm the effect of devolution. As complement for the environmental decentralization, Chapter 4 discussed the measures to strengthen the administrative capacities and cooperative systems of local governments, in aspects of institutions and system, organization, human resources, and finances. The policy proposals include delineating responsibilities and authorities across tiers of governments, strengthening the role of the Ministry of Environment as the control tower, enhancing the communication and information sharing, enhancing the role of regional environmental agencies in conflict management, emphasizing the element of cooperation in the human resource evaluation and training program, adopting the joint budget system, enhancing the financial assistance for local governments, strengthening the governance structure among the local governments and also with private organizations and resident communities

녹색성장의 근간이 되는 환경자원의 효율적 관리를 위해서는 다양한 정책행위자의 역할이 조화를 이룰 필요가 있으며, 정부조직 내에서도 중앙-지방 간을 비롯한 다양한 정부 간 관계의 효율적 정립이 요구된다. 특히 지방자치의 본격화와 함께 각종 환경사무의 지방이양·위임을 통해 지자체의 역할이 강화되면서, 중앙-지방 간 역할분담의 효율적 재정립과 정책조정, 협력강화, 지자체 역량강화 등의 필요성이 높아지고 있다. 이에 본 연구에서는 환경행정의 지방분권화(이양 및 위임) 이슈를 중심으로 중앙-지방 간 권한배분 및 분권화 현황분석, 분권화의 영향분석, 이해관계자(산업계) 의견조사, 지자체 역량분석 및 행정협력체계 분석을 통해 환경행정의 지방분권화와 관련한 발전방안들을 제시함으로써 환경행정체계의 효율화를 모색하고자 하였다. 제2장에서는 환경행정의 중앙-지방 간 관계에 대한 기존 이론 및 연구결과들을 검토하고, 관련 제도 및 현황을 진단하고, 권한이동에 관한 사례분석을 통해 이슈와 시사점을 도출하였다. 환경행정의 경우 타 부처에 비해 지자체에 의해 수행되는 비중이 월등히 높아, 지자체 업무효율 제고를 위한 역량강화와 협력강화의 필요성이 더욱 높은 것으로 보인다. 또한 최근 추진되고 있는 위임사무의 폐지에 따라 다수의 위임사무가 이양으로 전환됨에 따른 제도정비의 필요성이 있다. 제3장에서는 전년도에 수행된 정우현·박순애 외(2012)의 연구에 이어 환경행정의 위임 및 이양사무에 대하여 분권화 성과를 패널분석 기법 등을 이용하여 실증분석하였고, 분권화의 이해관계자로서 산업계 등의 의견조사를 병행하였다. 위임사무인 폐수배출업소 단속업무의 경우 위임 이후 적발건수와 단속적발률이 낮아졌으나 강한처분률에서는 유의한 영향이 나타나지 않았다. 또한 이양사무인 다중이용시설 실내공기질 단속업무에 있어서도 이양 후 적발건수와 단속적발률이 증가한 것으로 나타났으나 강한처분률에 대해서는 유의한 영향을 보이지 않았고, 단속 대상시설의 급증추세와 자료의 한계 등을 감안하면 분권화와의 인과관계를 유추하기에는 한계가 있었다. 산업계를 비롯한 이해관계자 의견조사에서도 규제권한의 지방위임 이후 뚜렷한 차이가 나타나지 않았다. 전년도(정우현·박순애 외, 2012)의 연구와 종합하면, 환경규제 행정의 위임사례에서는 위임 이후 집행수준이 정체하거나 오히려 감소한 것으로 나타나 중앙정부의 감시·감독 기능 강화가 필요할 것으로 보인다. 다만 이양에 대해서는 유의미한 결론을 도출하기에 연구자료의 한계가 있어 중장기적 관점에서 자료구축 및 지속적인 연구수행이 필요하다. 분권화의 영향을 완화시키기 위한 정책제언으로 민관협력의 실질적 추진, 지방공무원의 전문성 강화, 중앙정부의 보완적 감독기능 등을 논하였다. 제4장에서는 분권화의 보완책으로서 지자체의 환경행정 강화를 위한 역량강화 및 중앙-지방 간 협력강화를 모색하였다. 환경행정의 주체별로 환경행정체계의 문제점 및 개선방안, 협력현황, 역량진단 등을 수행하였고, 이를 바탕으로 제도와 시스템, 조직, 인사, 재무의 4개 측면에서 정책제언을 도출하였다. 협력강화에 있어서는 환경법령체계의 개선 및 기관 간 책임과 권한의 명확화, 환경부의 콘트롤타워로서의 역할 제고, 부처/기관 간 사무재배분 및 의사소통·정보공유 확대, 지방환경청의 갈등관리 기능 제고, 인사교류, 인사평정지표 및 공무원 교육 프로그램의 협업 요소 강화, 국세와 지방세 비율 조정 및 공동예산 고려 등을 제시하였다. 지자체 역량강화방안으로서는 집행비용 및 실질적 비용의 고려, 지자체의 자율적 제도 구축, 조직개선 및 기능조정, 공무원의 전문성 제고와 처우 개선, 인건비의 고려 및 예산지원 강화, 지자체 간 거버넌스, 민간기관 및 주민과의 거버넌스 개선을 위한 민간조직 활성화 등을 제시하였다.
