군부대 주둔 및 이전 부지의 환경관리 정책 : 토양ㆍ지하수 환경을 중심으로

dc.description.abstract Soil and groundwater contamination at Korean and U. S. military bases has been recently reported, and especially, responsibility for cleaning up of soil and groundwater contamination at returning U. S. military bases has been a social issue with criticism in South Korea over the past decade. Among administrative measured contamination sites of the Special Soil Contamination Management Facilities(SSCMF) by the Ministry of Environment, 8% is the military facilities mostly contaminated with Total Petroleum Hydrocarbon(TPH). Soil and groundwater contamination sites of the Korean military bases have been cleaned up. Eighty of the U. S. military bases have already returned or planned to return to Korea at the time of September 2017. Fifty four bases were already returned and the 26 are planned to return. For reviewing the U. S. overseas environmental policy and returning military bases case studies, it would be consistent in the United States government to burden the clean-up cost of the U. S. military base closures to the Korean government. This study tries to apply the ‘Polluters pay principle’ for clean-up of the U. S. military base closures and considers various approaches; however, it would not be feasible due to the U. S. overseas environmental policy and the SOFA between South Korea and the U. S. For planned U. S. military returning bases, it seems no other way but Korea investigates and cleans-up the contaminated sites at her own expense; however, it is necessary to should negotiate revision of the SOFA and the environmental agreements so that Korea has access to the U. S. military bases and site information and the United States will be liable for environmental pollutions at all U. S. bases, including the U. S. military bases in Pyeongtaek. To do so, the willingness of the Korean government should be enhanced. Based on rational principles and logic, negotiations between Korea and the United States should be continued for the benefits of both countries. Regarding site contamination, strict enforcement of Soil Environment Conservation Act and its intra- and/or international public affairs should be established not only for the U. S. military returning bases but also for the Korean military bases. -
dc.description.abstract 우리 군과 미군 반환기지의 토양·지하수 오염은 다수 보고되어 있다. 특히, 지난 10여 년간 반환된 미군 기지 토양·지하수 오염부지의 정화 책임과 비용 부담은 사회적인 이슈가 되었다. 환경부의 특정토양오염관리대상시설 현황 중 행정 처분을 중심으로 한 우리 군의 토양오염 실태를 파악해 본 결과, 우리나라에서 행정 처분된 8%가 군부대 내 시설이며, 대부분 토양오염대책기준 이상의 총석유계탄화수소(TPH)로 오염되어 있다. 토양·지하수 오염이 확인된 우리 군부대 부지의 경우에는 정화 사업을 시행하고 있다. 2017년 9월 현재 기준으로 반환이 완료되었거나 반환이 예정된 미군 기지는 총 80개소이다. 이 중에서 54개소는 이미 반환이 완료되었으며, 26개소는 반환이 예정되어 있다. 해외주둔 미군 기지에 대한 미국의 환경 정책과 여러 국가에서의 반환 사례를 볼 때, 미국이 우리에게 반환미군 기지의 환경오염에 대한 치유 비용을 부담시키는 것은 미군 주둔국에 대해 취해 온 미국 정부의 일관된 입장이었다. 우리는 ‘오염자부담원칙’을 적용하여 미군 반환기지 환경오염에 대한 미국의 책임을 묻고, 이에 대한 다양한 정책적 접근 수단과 방법을 조사하였다. 미국의 해외 군사기지에 대한 현행 미국의 환경 정책과 한미 SOFA를 고려할 때, 현재는 우리가 미군 반환기지에 대한 오염 정화 비용을 지불하는 것 외의 다른 방법을 찾아내기 어렵다. 기존에 계획된 미군 반환기지에 대해서는 우리의 비용으로 오염부지를 조사하고 정화하되, 미군 기지에 대한 접근과 정보 협조를 담보하는 방향으로 환경협정의 개정을 추진하는 것이 우리가 선택할 수 있는 실리적인 방안으로 보인다. 환경협정의 개정 내용은 평택에 조성한 미군 기지를 비롯하여 향후 모든 미군 기지에서 환경오염에 대해 미국이 책임지고 비용을 조달할 수 있도록 SOFA와 관련 규정을 변화시키는 것이다. 이를 이행하기 위해, 우리 정부 당국의 정책 의지가 고양되어야 한다. 합리적이고 명확한 원칙과 논리를 기반으로 한국과 미국이 서로 혜택이 될 수 있는 한미 간의 협의를 지속해야 한다. 부지 오염에 대해서는 미군뿐만 아니라 우리 군에 대해서도 국내 환경법의 엄격한 적용, 그리고 지속적인 대내외 홍보 및 미군 기지가 위치한 지방자치단체와의 협력이 이루어져야 한다. -
