나고야의정서와 현지외 보존기관으로서 연구소재은행의 역할

Abstract

2014년 나고야의정서가 발효된 후, 우리나라는 2017년 8월 17일 당사국이 되었고 나고야의정서를 이행하기 위한 「유전자원의 접근？이용 및 이익 공유에 관한 법률」을 제정？시행했다. 이용자의 의무사항을 담은 시행규칙은 올해 8월 시행을 앞두고 있다. 생물자원을 확보, 보존하여 연구자들에게 제공하는 연구소재은행은 현지외 보존기관으로서의 기능을 하고 있다. 현지외 보존기관은 자원제공자 및 기탁처로서 국내외 법률에 따른 의무사항을 이해하고 합법적 자원 관리, 이용자에 대한 올바른 정보 제공 등의 역할이 요구 된다. 하지만 연구소재은행을 대상으로 한 나고야의정서 인식조사 결과, 이해 정도나 대응 마련이 미흡한것으로 나타났다. 따라서 본 연구에서는 국내외 나고야의정서 이행법률과 해외 생물자원센터의 대응 현황을 살펴보고 앞으로 현지외 보존기관으로서 연구소재은행의 역할과 방향성을 제시하고자 한다. The Nagoya Protocol entered into force in 2014. The Republic of Korea enacted a law on access to genetic resources and benefit sharing for implementing the Nagoya Protocol and became a party to the Protocol on August 17, 2017. The enforcement rules for the obligations of users are scheduled to come into force in August this year. Research Resource Centers (RRCs) collect, develop, preserve and distribute biological resources and play a role as ex-situ conservation institutes. RRCs provide research material and accept deposits for preservation and distribution. RRCs should be aware of the obligations in compliance with domestic and foreign laws, conduct resource management, and provide users with accurate information. However, the results of a survey on RRCs’ awareness of the Nagoya Protocol demonstrated that they are not familiar with its requirements and are not properly prepared. In this study, we review the domestic and international access and benefit sharing laws and policies regarding ex-situ conservation institutes in an effort to provide insight into the future role of RRCs.
