친환경자동차 협력금제도의 효과적 도입을 위한 연구

Abstract

친환경차 협력금제도의 효과적 도입을 위해 이전 저탄소차 협력금도입 당시의 쟁점을 포함하여 친환경차 협력금제도 도입 시 문제 제기의 가능성이 있는 쟁점에 대해 살펴보았다. 또한, 이를 해결하고 제도를 효과적으로 도입할 수 있는 적용방안에 대해서도 몇 가지 제안하였다. 살펴본 주요 쟁점으로는 이중과세 및 이중부과 여부, 한미 FTA 협정 위반 여부, 온실가스 및 대기오염물질 대상 범위, 국내 자동차 제작사 역차별 문제이다. 이중과세 및 이중부과 여부의 경우는 헌법재판소 판례를 통해 살펴본 결과 협력금제도가 이중과세 및 이중부과로 보기 어려웠다. 한미 FTA 협정 위반의 경우도 협정문에 근거해서 볼 때 위반 가능성이 낮았다. 친환경차 협력금제도의 효과적 도입을 고려할 때 온실가스의 대상은 이산화탄소로 한정하고 대기오염 물질의 대상은 대기환경보전법의 제작차 배출허용기준과의 연계 측면에서도 배출허용기준 대상 물질인 질 소산화물과 탄화수소로 정하고 적용기준은 질소산화물과 탄화수소의 총배출량을 적용하는 방안을 제안하였다. 국내 자동차 제작사 역차별 문제를 해결하기 위해서는 모든 차량에 일괄적으로 제도의 기준을 적용하는 것이 아니라 휘발유 및 LPG 차량과 경유 차량에 대한 각각의 기준을 마련하여 적용하는 방안을 제안하였다. This paper studies several critical issues surrounding the bonus-malus system for green cars to effectively introduce the issues of attempting the introduction of the bonus-malus system for a low-carbon car. In addition, some measures are suggested to solve the issues introduced and improve the system. The Issues reviewed are: double taxation or impositions levied to car buyers; breach of Korea-US FTA; what kinds of green-house gases and air pollutants are to be restricted; and reverse discrimination of domestic car makers. In the case of double taxation in line with the decisions at the Constitutional Court, it is difficult to see it as being levied twice. Based on the content of the agreement it is also considered unlikely that it violates the Korea-US FTA. When considering effective introduction of the green car system, it is advised that carbon dioxide (CO2) in green-house gases and nitrogen oxide (NOx) and hydrocarbon (HC) in air pollutants should be restricted. A suggested measure for solving reverse discrimination on domestic car makers is to design emission range splitting for gasoline and diesel cars respectively.
