원자력발전소 해체에 따른 환경영향평가 도입 필요성 연구

Abstract

The aim of this research is to address the issues, that was raised after the decision to permanently close ‘Kori Unit1 nuclear power plant’, concerning the conflict between the law and legal systems on Radiational Environmental Impact Assessment. In order to resolve this issue, the law and legal systems of nuclear power plant decommissioning process and its well established environmental impact statements(EIS) or environmental impact assessment(EIA) system from countries which experienced nuclear decommissioning, such as United States of America and United Kingdom were investigated. South Korea also have managed to establish a good basic structure for decommissioning of nuclear power plant(NPP). However, the EIA of Korean system for NPPs decommissioning is not an independent process of its own but just a part of strategic decommissioning plan for old NPP projects. Based on the investigation of two countries, introduced earlier, all have well defined and well-executed laws and principals for NPP decommissioning which involves many governmental bodies and commercial parties. Also with numerous cases which was in some cases successful but not for some, the perfection towards a better policy seemed to work. However, the well-established law and policies cannot be embedded into the law and policies without the research aimed for adaptation of foreign laws and policies. During 2013 and 2015 many laws has been amended for a better EIS(or ES) plans which suggest a long-term research on this subject is needed. The objective of our research is to assist establishing eco-friendly NPP decommissioning process through EIA which will be essential for future NPP deconstruction projects.

본 연구는 2017년 6월에 영구정지 승인을 받은 고리1호기 원자력발전소에 대한 방사선환경영향평가의 법적·제도적 문제점을 도출하고자 하였으며, 이를 위해 원자력발전소 해체에 관한 국외의 환경영향평가제도 사례를 분석하였다. 현재 우리나라의 방사선환경영향평가는 독립적인 행정절차가 아닌 해체계획서의 일부분으로 포함되어 있다. 미국과 영국의 경우 원자력발전소 해체와 관련한 환경영향평가제도는 다양한 정부부처와 전문 연구기관의 참여 그리고 전 국민을 대상으로 하는 의결수렴 절차 등을 바탕으로 수십 년에 걸친 지속적인 연구를 통해 개선되었으며, 이를 기반으로 원자력발전소의 안전한 해체과정을 다수 경험하였다. 미국의 경우 NRC(Nuclear Regulatory Commission)에서 제정한 NUREG(US Nuclear Regulatory Commission Regulation)와 U.S. EPA(Environmental Protection Agency)에서 제정한 NEPA(National Environmental Policy Act)에 따라 NRC가 EIS(Environmental Impact Statement)를 작성하며, 이를 U.S. EPA에서 검토하는 안전한 원자력발전소 해체 절차가 확립되어 있다. 해당 기관은 각자의 업무에 맞게 가이드라인을 작성하여 원자력발전소 해체 사업자 및 관계자, 그리고 국민에게 정보를 제공함으로써 EIS를 통헤 원자력발전소의 안전하고 친환경적인 해체를 유도하고 있다. 영국의 경우 ONR(Office of Nuclear Regulation)에서 제정한 Nuclear Reactors EIADR(Environmental Impact Assessment for Decommissioning Regulations)을 통해 원자력발전소 해체에 따른 환경영향을 최소화할 수 있는 EIA(Environmental Impact Assessment)를 작성하도록 유도하고 있으며, 이에 대한 검토를 HSE(Health and Safety Executive)에 의뢰하여 원자력발전소 해체사업의 환경적 영향에 관한 정보를 공공에 제공하고 주민참여를 권장함으로써 원자력발전소의 친환경적 해체를 선도하고 있다. 현재 국내 원자력발전소 해체 관련 법·제도를 살펴보면, 2013년과 2015년에 걸쳐 핵심내용에 대한 법적 개정이 있었으나 현재 법·제도 제정 상황을 해외사례와 비교해 봤을 때 장기적인 연구가 필요하다. 특히 방사선환경영향평가는 해체계획서의 일부분으로 인식되어 현재까지 법·제도적 문제점이 다수 존재함을 본 연구를 통해 도출하였으며, 가장 시급한 몇 가지 문제점을 제시하고, 이에 대한 개선방안 및 향후 연구계획에 고려되어야 할 부분도 제시하였다. 마지막으로 본 연구는 향후 원자력발전소 해체와 관련해 우선적으로 연구되어야 하는 연구분야를 도출함으로써 향후 세부적인 연구방향 설정에 활용할 수 있을 것이다.
