국토ㆍ환경 통합관리의 실현성 강화를 위한 제도적 개선방안

Abstract

본 논문은 2018년 ？국토계획 및 환경보전계획의 통합관리에 관한 공동훈령？(약칭, ？국토？환경 통합관리 공동훈령？) 시행으로 본격화된 국토？환경 통합관리제도가 아직도 활성화되지 못한다는 문제인식으로부터 시작되었다. 연구 과정에서 공동훈령의 내재적 한계, 근거 법률의 문제, 계획수립체계의 문제, 통합관리 대상사업의 부재 등의 문제점을 찾아낼 수 있었다. 이들 문제점 분석하여 국토？환경 통합관리의 실현성을 강화할 수 있도록 공동훈령의 개선, ？국토계획법？ 등 관련 법률의 개정, 국토계획의 보완 방안, 환경계획 수립체계의 개선방안 등을 제시하였다. 또한 국토？환경 통합관리의 실효성 확보를 위해 전문화된 법률과 제도의 필요성을 주장하였다. 논문의 후반부에서는 국토？환경 통합관리의 실현성과 효과성을 높일 수 있도록 국토？환경 통합관리 대상지역을 지정？관리하는 통합계획구역제도, 국토？환경 통합관리대상시설을 발굴？조성하기 위한 기후？생태기반시설의 제도화 방안을 제시하였다. 본 연구를 통해 실현성과 실천력이 강화된 국토？환경 통합관리의 추진 틀이 필요하다는 인식이 확대되기를 기대한다. The aim of this study is to discover the causes of the failure to activate the integrated management system of land-use planning and environmental planning, which began in earnest with the enforcement of the Joint Command on the Integrated Management of Land-Use Planning and Environmental Planning (shortened to “the Joint Command”) in 2018. In the process of this research, problems were found such as the inherent limitations of the Joint Command, problems in the underlying law and planning system, and the absence of the target projects for the integrated management. By analyzing these problems, the researcher suggested improving of the Joint Command, revisioning related laws such as National Land Planning and Utilization Act, and improving the existing environmental planning establishment system to strengthen the feasibility of the integrated management of land-use planning and environmental planning. In addition, it was suggested that specialized laws and systems were needed to establish an effective integrated management system of land-use planning and environmental planning. In the last part of this study, to realize the feasibility and effectiveness of integrated management the researcher proposed, first, introducing a planning zone system that designates the target areas for integrated land-use and environmental planning, and second, phasing in climate-resilient and ecological infrastructure as a new type of infrastructure. The researcher hopes that this study would increase awareness of the need for a new spatial planning framework for integrated management of land-use planning and environmental planning endowed with greater effectiveness and practicality than past frameworks did.
